Terms of Service

By downloading, installing, or using KineVision ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and KineVision ("we," "us," or "our") regarding your use of the App.

KineVision is a video analysis application designed for coaches, athletes, and sports professionals to analyze athletic movements and performance. The App provides tools including:

• •Video recording and playback with advanced controls
• •Drawing and annotation tools for movement analysis
• •Angle measurement and comparison features
• •Slow motion and frame-by-frame analysis

All videos are stored locally on your device. We do not host, store, or have access to your video content.

You must be at least 13 years old to use KineVision. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the App, you represent and warrant that you meet these eligibility requirements.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS devices for your personal or professional use.

You are solely responsible for all videos, images, and content you create, record, or analyze using the App ("User Content"). You retain all ownership rights to your User Content.

You agree to use the App in accordance with all applicable laws and regulations. You must:

• •Obtain necessary consents and permissions before recording individuals
• •Respect the privacy and rights of athletes, coaches, and other individuals
• •Comply with applicable data protection and privacy laws
• •Not use the App to record or distribute content that is illegal, harmful, or infringes on others' rights

The App, including its design, functionality, code, graphics, interface, and all related intellectual property, is owned by KineVision and protected by copyright, trademark, and other intellectual property laws.

"KineVision" and the KineVision logo are trademarks of KineVision. You may not use these trademarks without our prior written permission.

KineVision may offer premium features, subscriptions, or in-app purchases. These purchases are processed through Apple's App Store and are subject to Apple's Terms of Service and refund policies.

Prices are subject to change with notice. Price changes will not affect existing subscriptions until renewal.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• •The App will be uninterrupted, secure, or error-free
• •Any defects will be corrected
• •The App is free from viruses or harmful components
• •Results obtained from the App will be accurate or reliable

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINEVISION AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• •Your use or inability to use the App
• •Any unauthorized access to or use of your device or data
• •Any errors, mistakes, or inaccuracies in the App
• •Personal injury or property damage resulting from your use of the App
• •Any interruption or cessation of the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless KineVision and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• •Your use or misuse of the App
• •Your violation of these Terms
• •Your violation of any rights of another party
• •Your User Content

The App may integrate with or link to third-party services, including Apple's App Store, payment processors, and analytics services. Your use of these third-party services is subject to their respective terms and privacy policies.

We are not responsible for the content, accuracy, or practices of third-party services. Your interactions with third parties are solely between you and them.

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

You may stop using the App at any time by deleting it from your device. Upon termination, your license to use the App immediately ceases, but provisions regarding intellectual property, disclaimers, liability limitations, and indemnification shall survive.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KineVision operates, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

We may update these Terms from time to time to reflect changes in our practices, the App, or legal requirements. When we make significant changes, we will:

• •Update the "Last updated" date at the top of this page
• •Notify you through the App or via other reasonable means
• •Post updates on our website

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and KineVision regarding the App.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
